North Carolina Civil Trial Practice, Second Edition, is North Carolina's only practitioner treatise on civil trial practice and procedure, with application of the N.C. Rules of Evidence. There are a number of books for practitioners in North Carolina in various, distinct subjects (e.g., in torts, workers' compensation, real property law, family law, North Carolina corporations, North Carolina evidence, Employment Law and North Carolina Criminal Procedure). However, there is currently no other civil trial practice book available in North Carolina. This work fills that gap and is designed to be used by all civil trial lawyers in North Carolina, whether plaintiff or defense-oriented.
Now fully updated to include more authorities and trial techniques since the publication of the first edition in 2012, the second edition comprehensively covers the procedural and substantive law of North Carolina civil cases as well as the full range of trial practice techniques – from pre-trial procedure, mediation, jury selection, open statement, direct and cross-examination, jury charge conference, to closing argument. G. Nicholas (Nick) Herman is a litigator with The Brough Law Firm in
Chapel Hill, North Carolina, where his practice is devoted to complex
litigation and appeals, including county and municipal defense, zoning issues,
land-use regulation, condemnation cases, employment law issues, business
litigation and personal injury. He is also an adjunct professor at Campbell Law
School and North Carolina Central University School of Law, and has otherwise
served as an adjunct faculty member at Duke University School of Law, The
University of North Carolina School of Law, and Elon University. Mr. Herman is
the author of a number of other books—on the law of evidence, legal counseling,
interviewing, negotiating, mediating, and plea bargaining. Along with his
extensive trial experience, he has written over 60 articles in civil and
criminal law and has argued over 40 cases in the appellate courts of North
Carolina and the United States Court of Appeals for the Fourth Circuit.
