With the relocation of Big Tech companies to Texas increasingly hitting the news, the need for a seasoned understanding of the existing law cannot be overstated. Texas Intellectual Property Law, fourth edition, provides precisely that, the knowledge and experience of a  lawyer  praised as a top lawyer in Texas and a "thought leader" in the IP field.  The book covers the principles and practice of the law of trade secrets, trademark, copyright and related intellectual-property torts as the law is applied in Texas. Designed for practitioner use, it is accessible and comprehensive in its citation to Texas authorities and offers thorough analyses of existing law as codified in state and federal statutes, and as interpreted by Texas state and federal courts, the Fifth Circuit Court of Appeals, and the United States Supreme Court.  IP or General Counsel who need a quick, but comprehensive refresher on the state of the law in trade secrets, trademark, copyright, non-competes and related IP torts, will find it an ideal reference.

Now completely updated, the new fourth edition reflects the significant changes in the law that have occurred since the previous edition in 2016 was published, namely, cases decided under The Texas Trade Secrets Act (TUTSA), which replaced 50 years of jurisprudence on common-law trade-secret misappropriation in 2013, the recent amendments to TUTSA, the federal Defend Trade Secrets Act passed by Congress in 2016, and critical U.S. Supreme Court and Fifth Circuit decisions in copyright and trademark cases. The appendix further provides direct links to the necessary Texas and federal statutes and federal regulations.

Texas Intellectual Property Law, fourth edition, equips its readers with the primary material and expert guidance they need to effectively gauge the winds of change in Texas and manage the diverse intellectual property issues they will confront in their day-to-day practice.

Herbert J. Hammond is consulting counsel with Holland & Knight, LLP in Dallas, where he specializes in patent, trademark, copyright, trade-secret, and computer-law litigation and acts as an arbitrator, mediator, and expert witness in intellectual-property disputes.

He graduated from New York University School of Law in 1976 and is licensed to practice in Texas and before the United States Patent and Trademark Office. He is a member of the American Law Institute where he is in the Member Consulting Group for the Restatement of Copyright.

He has been recognized by numerous organizations including Chambers USA in the area of intellectual property, by The Best Lawyers in America in the areas of Intellectual Property Litigation, Patent Litigation, Trade Secret Law, and Trademark Law, by Thompson Reuters which included him in the Top 100 Overall Texas Super Lawyers in Intellectual Property Litigation, as well as IAM Patent 1000 2016 which praised him as a “thought leader” who “can justly claim to have written the book on Texas Intellectual Property.” He also has been listed multiple times in D Magazine’s Best Lawyers in Dallas.  He is a frequent speaker at CLE programs and has written many chapters and articles on intellectual-property topics.

Texas Intellectual Property Law, fourth edition, is the treatise on intellectual property litigation that we turn to in our firm’s library. Herbert Hammond shares a wealth of legal insights and practical experience that are invaluable to either an experienced IP litigator or someone new to the subject.---Darin M. Klemchuk, IP trial attorney, Klemchuk LLP

The fourth edition of Texas Intellectual Property Law contains impressive depth and breadth of coverage of non-patent IP topics while remaining concise enough to be a desk reference. The author's extensive citations throughout the book support his succinct explanation of each of the topics addressed. Any Texas IP attorney—and for the federal topics, any Fifth Circuit IP attorney—will find this to be an efficient and helpful resource. ---Prof. Lee Ann Wheelis Lockridge, Professor of Law, Louisiana State University Law Center
