Preview Page The Cabinet of Ministers of Ukraine and the Government of the Russian Federation, hereinafter the Contracting Parties,
developing the basic provisions of the Agreement on Cooperation in the domain of investment activity of 24 December 1993,
having the intention to create and maintain favorable conditions for mutual investments,
desiring to create favorable conditions for the expansion of economic cooperation between the Contracting Parties,
have agreed on the following:
Article 1. Definitions
For the purposes of the present Agreement:
1. The term “investments” means all types of property and intellectual valuables which are contributed by an investor of one Contracting Party on the territory of the other Contracting Party in accordance with the legislation thereof, and in particular: (a) moveable and immoveable property, and also respective property rights; (b) monetary means, and also securities, obligations, deposits, and other forms of participation; (c) intellectual property rights, including author’s and neighboring rights, trademarks, rights to an invention, industrial designs, models, and also technological processes and know-how; (d) right to the effectuation of economic activity, including the right to explore for, develop, and exploit natural resources.
A change of the type of investments to which means will be contributed will not influence the character thereof as investments provided that such change will not be contrary to legislation of the Contracting Party on whose territory the investments have been effectuated.
William E. Butler, Emeritus Professor of Comparative Law in the University of London, attached to University College London, is the John Edward Fowler Distinguished Professor of Law at the Dickinson School of Law, Pennsylvania State University, and Founder and Director of The Vinogradoff Institute.
An authority on the legal systems of Russia and former Soviet nations, he is the author, co-author, editor or translator of more than 3,500 books and articles on Russian, Soviet, Kazakhstan, Ukrainian, Uzbekistan, and other Commonwealth of Independent States legal systems. He has acted as Counsel to the EBRD, European Union, World Bank, United Nations, and Department for International Development of the United Kingdom on individual law reform projects.
The recipient of numerous honors for his service to Russian and international law, Professor Butler is Academician of the National Academy of Sciences of Ukraine and the Russian Academy of Natural Sciences, Associate of the International Academy of Comparative Law, and Member of the Russian Academy of Legal Sciences. He has been elected to his fourth term as a member of the Russian International Court of Commercial Arbitration. In 2003 Professor Butler was awarded the G. I. Tunkin Medal by the Russian International Law Association.
