Consumer Protection


I. REGULATORY FRAMEWORK

The most relevant regulations regarding consumer protection in
Colombia are:

A. The Political Constitution—Article 78
The law shall regulate quality control in connection with goods and
services offered and provided to the community as well as of
information which must be supplied to the public in connection
with their marketing. Those who, in the process of producing and
marketing goods and services, cause harm to health and safety or
fail to provide suitable supplies to consumers and users, shall be
liable for their actions as provided by law.

The state shall guarantee the participation of consumer and user
organizations in examining the provisions that concern them. To
enjoy this right, the organizations in question must be representative
and must observe democratic internal procedures.

B. The Political Constitution—Article 365
Public services are inherent in the social purpose of the state. It is
the duty of the state to ensure that they are provided efficiently to
all inhabitants of the national territory (...).

C. Law 73 of 1981
Law 73 of 1981 regulates the relationship between producers, suppliers,
vendors, importers and consumers. This law has been instrumented,
amongst other, by the following regulations:

Eduardo Varela-Pezzano is a Lawyer and Specialist in Intellectual
Property Law from Universidad del Rosario (Bogota, Colombia); an
Intellectual Property Law Professor at Universidad del Rosario; an Author
of several books and articles on Freedom of Speech, Patent, Trademark,
Copyright and Entertainment Law; and an Associate Attorney at Cavelier
