Article 1. Subject-Matter of Regulation of Present Federal Law
1. The subject-matter of regulation of the present Federal Law shall be social relations arising in the sphere of the prevention of violations in the Russian Federation.
2. The present Federal Law shall establish the legal and organizational foundations of the system for the prevention of violations, general rules for the functioning thereof, basic principles, orientations, types of prevention of violations, and forms of prophylactic activity, powers, rights, and duties of subjects of the prevention of violations, and persons participating in the prevention of violations.
Article 2. Basic Concepts Used in Present Federal Law
For the purposes of the present Federal Law the following basic concepts shall be used:
(1) violation – crime or administrative violation representing an unlawful act (or action, failure to act) entailing criminal or administrative responsibility;
(2) prevention of violations – aggregate of measures of social, legal, organizational, information, and other character directed towards the identification and elimination of the reasons and conditions facilitating the commission of violations, and also the exerting of educational impact on persons for the purposes of not allowing the commission of violations or anti-social behavior;
(3) system of prevention of violations – aggregate of subjects of prevention of violations of persons participating in the prevention of violations, and measures taken by them for the prevention of violations, and also the foundations of the coordination of activity and monitoring in the sphere of the prevention of violations;
(4) persons participating in prevention of violations – citizens, social associations, and other organizations rendering assistance (or facilitation) to subjects of prevention of violations within the framework of the realization of their rights in the sphere of the prevention of violations in accordance with the present Federal Law and other federal laws;
William E. Butler, Emeritus Professor of Comparative Law in the University of London, attached to University College London, is the John Edward Fowler Distinguished Professor of Law at the Dickinson School of Law, Pennsylvania State University, and Founder and Director of The Vinogradoff Institute.
An authority on the legal systems of Russia and former Soviet nations, he is the author, co-author, editor or translator of more than 3,500 books and articles on Russian, Soviet, Kazakhstan, Ukrainian, Uzbekistan, and other Commonwealth of Independent States legal systems. He has acted as Counsel to the EBRD, European Union, World Bank, United Nations, and Department for International Development of the United Kingdom on individual law reform projects.
The recipient of numerous honors for his service to Russian and international law, Professor Butler is Academician of the National Academy of Sciences of Ukraine and the Russian Academy of Natural Sciences, Associate of the International Academy of Comparative Law, and Member of the Russian Academy of Legal Sciences. He has been elected to his fourth term as a member of the Russian International Court of Commercial Arbitration. In 2003 Professor Butler was awarded the G. I. Tunkin Medal by the Russian International Law Association.
